C8 is a chemical used in the manufacture of Teflon that was discharged from the DuPont Washington Works plant for decades. In 2005, DuPont reached a settlement in a C8 class action lawsuit which, among other things, required the formation of the C8 Medical Panel. (Leach v. E.I. Du Pont De Nemours & Co., No. 01-C-608 (W. Va. Cir. Ct.)) The same settlement also created the C8 Science Panel, which in October 2012 reported that it had established a probable link between exposure to C8 contaminated drinking water and a number of illnesses, including kidney cancer, testicular cancer, thyroid disease, inflammatory bowel disease, preeclampsia, and high cholesterol.

The 2005 settlement also stipulated that class members who consumed C8-tainted drinking water from one of six Ohio and West Virginia water districts for at least 1 year prior to December 3, 2004 would have the right to sue for personal injuries if they developed a disorder that the C8 Science Panel ultimately deemed a “probable link” disease. On April 8, 2013, the U.S. Judicial Panel on Multidistrict Litigation (JPML) established In Re: E.I. DuPont De Nemours and Company C-8 Personal Injury Litigation, MDL No. 2433, for all federally filed personal injury and wrongful lawsuits filed in accordance with the C8 class action lawsuit settlement.
According to mydailysentinal.com, the C8 Medical Panel has recommended the following diagnostic screening protocols for all DuPont C8 class action lawsuit settlement class members:
- Screening of all class members over 2 years of age for high cholesterol via blood testing.
- A one-time thyroid function test for all adult class members, as well as an “especially
determined effort to identify pregnant women, or women trying to become pregnant, and
screen them for thyroid disease.”
- Screening for gestational hypertension and pre-eclampsia, a standard component of prenatal
care, should be made available to all class members who become pregnant.
- Distribution of a questionnaire for men, 15 through 50, who are members of the settlement
class to evaluate risk factors related to testicular cancer. Routine pediatric check-ups should
include an examination of the genitalia until self-examination can be taught. Ultrasound
exams for high risk individuals.
- As there is no accurate test available for mass screening of kidney cancer, the Panel
recommends an imaging test for class members who suffer from gross hematuria or an
The C8 Medical Panel has yet to make a recommendation as to how long medical monitoring should continue into the future.
