In that jury decision, a medical device maker was absolved of further liability regarding a patient alleging negligence.

“The case in question involved a unique set of circumstances having little relevance in the majority of da Vinci lawsuit cases,” says Miller.

As reported in a CNBC article dated March 19, 2013, the da Vinci system utilizes robotic arms, cameras and a remote control system to allow intricate surgeries to be performed through tiny incisions. Used in a variety of procedures including gynecologic and urology surgery, the da Vinci robotic surgery system was used in over 450,000 instances last year alone.

Miller’s law firm represents a growing number of plaintiffs alleging that the device’s maker, Intuitive Surgical Inc., of Sunnyvale, California, has been at fault in marketing a device causing harm to the law firm’s clients. In some cases improper use of the device by surgeons is also alleged.
