The law firm of Schlichter, Bogard & Denton, LLP is investigating claims for individuals residing in southern Ohio and West Virginia who may have been exposed to the toxic chemical perfluorooctanoate, or C8, in their drinking water.
On April 8, 2013, the United States Judicial Panel on Multidistrict Litigation ordered that all such cases filed in federal court be transferred to the United States District Court for the Southern District of Ohio for consolidated, pretrial proceedings (E.I. DuPont De Nemours and Company C8 Personal Injury Litigation, MDL No. 2433).
For nearly half a century, DuPont used C8 at its Washington Works Plant in Parkersburg, West Virginia to manufacture Teflon and other products. The manufacturing process released significant amounts of the toxic chemical, C8, into the surrounding air, water, and landfills. In October 2012, a panel of doctors reported several probable links between C8 exposure and certain serious health conditions, including high cholesterol, kidney cancer, thyroid disease, testicular cancer, ulcerative colitis, and pregnancy-induced hypertension. The findings stemmed from a series of studies, which examined approximately 70,000 area residents.
According to a May 29, 2013 report published in the The Marietta Times, the following six districts near the DuPont Washington Works Plant have been found to have had C8 contamination in their drinking water:
- Little Hocking, Ohio
- City of Belpre, Ohio
- Tuppers Plains, Ohio
- Village of Pomeroy, Ohio
- Lubeck Public Service District, West Virginia
- Mason County Public Service District, West Virginia
Individuals who consumed drinking water in one of these water districts for at least one year prior to December 3, 2004 and suffered any of these injuries have a right to file a claim. Surviving heirs of individuals who were diagnosed with one or more of the illnesses linked to C8 may also be entitled to pursue claims. Numerous individuals have already filed lawsuits against DuPont seeking compensation for their injuries. In April, the U.S. Judicial Panel on Multidistrict Litigation ordered that all lawsuits filed in federal against DuPont involving exposure to C8, be transferred to the U.S. District Court, Southern District of Ohio, for consolidated proceedings.
