This Skechers Lawsuit(Case No. 3:13-cv-00443-TBR) was filed on April 29, 2013 and is part of MDL 2308. As with other Skechers lawsuits recently filed by Wright & Schulte, this case will be heard in the U.S. District Court of the Western District of Kentucky, Louisville Division.

Alleged Injuries in Skechers Lawsuit
According to court documents, the plaintiff bought his Shape-Ups in April 2010 after various ads for these shoes had alleged that they could provide wearers with a number of health benefits. Specifically, in addition to claiming that Shape-Ups could help wearers improve the muscle tone of their legs, buttocks and abs, Skechers ads also contended that wearing these shoes could help consumers get in shape without having to go to the gym.

The lawsuit further contends that within one month of wearing his Shape-Ups on a daily basis, the plaintiff fell while walking on a flat surface when the allegedly unstable rocker bottom of one of his Shape-Ups rolled forwards and twisted his ankle. Upon seeking emergency medical care for his excruciating pain, medical professionals informed the plaintiff that he had fractured his right arm, sprained his right wrist and sprained his right ankle. While the plaintiff had to wear an ankle and wrist brace and undergo physical therapy to treat his sprains, he also had to undergo surgery for his broken arm.

The complaint goes on to contend that “the health risks of Skechers outweigh the absence of any benefit provided to [individuals who wear Shape-Ups]” and that the defective rocker-bottom design of Skechers Shape-Ups was directly responsible for causing the plaintiff's injuries.

Class-Action Skechers Lawsuit Settled for $40 Million

Skechers claims in its ads regarding Shape-Ups alleged health benefits have not been validated by a credible scientific research, allege court documents. In fact, an independent study overseen by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [ June 2010]

In fact, Skechers misrepresentation of Shape-Ups health benefits has been the basis of thousands of product liability lawsuits filed against the company and has cost Skechers millions in settlement awards to consumers. In May 2013, a federal judge approved a $40 million Skechers settlement in a class-action Skechers lawsuit based on hundreds of thousands of consumer claims that Skechers intentionally mislead consumers in its Shape-Ups advertising. As part of this ruling, the court also found that Skechers is no longer allowed to run ads for its toning shoes.
