The victim was allegedly struck by a 25 year old who had been served alcohol at a local bar until she was intoxicated at three or four times the legal limit, according to court documents for the case number D-1-GN-12-003667 in Travis County District Court. The petition states that the driver lost control of her vehicle and struck the victim while she was walking on the sidewalk with her friends. The driver left the scene of the accident after striking the victim, but later returned.
The victim, a teenager, now requires continuous care. To help the family afford to care for the girl, the McMinn Law Firm sued the driver and the two bars that allegedly over-served her. According to court documents, the driver’s intoxicated state was “visible, evident and easily observable,” while she was at the bars, but she was not denied additional alcoholic beverages at either bar.
“What happened to my client is awful,” said Jason McMinn, one of the partners at the McMinn Law Firm. “She had her entire life ahead of her. She loved playing volleyball with her friends. She wanted to become a DPS officer when she grew up. All of that was wiped out by this terrible accident. I hope this case convinces people in Austin how important it is to drink responsibly and teaches bars here to serve patrons responsibly.”
The petition requested damages for past and future medical expenses, physical pain and suffering, mental anguish, physical impairment and physical disfigurement.
