Dr. Rafik Benaissa, brother of former SNC Lavalin executive Riadh Ben Aissa, has filed a petition for a writ of Mandamus with a Montreal Federal Court (Montreal Federal Court # T-1209-13), requesting that an investigation be opened for alleged RCMP violations in the SNC Lavalin affair.

The petition alleges all of the following 10 violations:

The concept of fairness was violated in the investigation.

The investigation willfully omitted a look at all proof and facts.

The investigation was not founded on any true legal grounds.

The investigation was founded on facts which are untrue and have come to abusive, prejudiced, politically-motivated, or arbitrary conclusions.

The investigation has shown abuse of power, unfairness, and malice.

The investigation willfully omitted Riadh Ben Aissa’s inhuman detention in a Switzerland jail cell.

The investigators have accepted Riadh Ben Aissa’s detention in solitary confinement in a Swiss prison cell, when at no time Riadh Ben Aissa, a Canadian citizen, has been declared or found guilty, or representing any danger to others by Swiss or Canadian Justices.

The investigators have committed subornation of perjury, intimidating Mrs. Cynthia Vanier in her Mexico prison cell in order to obtain from Mrs. Cynthia Vanier written incriminating testimony against Riadh Ben Aissa.

The investigators have accepted illegal testimony from Mr. Sami Bebawi, a fugitive from justice under a criminal investigation in Canada and who has escaped justice to Egypt. The Swiss and Canadian investigators have accepted false documents purchased in Egypt by Mr. Sami Bebawi and have given Mr. Sami Bebawi judicial immunity and a safe-conduct in return.

The investigators have proceeded with a Canadian Federal extradition request procedure of Mr. Riadh Ben Aissa despite all of the above serious violations.
