The vaginal mesh lawsuit lawyers at Wright & Schulte LLC, an experienced medical device law firm, are extremely pleased that the jury hearing arguments in the first federal bellwether trial of a vaginal mesh lawsuit has seen fit to award a woman injured by C.R. Bard’s Avaulta Plus device $2 million in damages. According to court documents filed in U.S. District Court, Southern District of West Virginia, the 8-member jury found that the Avaulta Plus mesh was defective, and that C.R. Bard failed to warn about the problems with the product. The Plaintiff, a 45-year-old woman from Georgia, was awarded $250,000 in compensatory damages and $1.75 million in punitive damages following 11 days of testimony and 12 hours of deliberations. (Cisson v. C.R. Bard Inc., 11-cv- 00195)

Wright & Schulte LLC, believes the outcome of this vaginal mesh lawsuit is a significant victory for all alleged victims of vaginal mesh complications, as rulings in bellwether trials are often used to gauge the strength of plaintiffs ‘claims in similar cases. The Firm is already representing numerous women who have allegedly experienced painful transvaginal mesh or bladder mesh complications due to products manufactured by C.R. Bard and other companies. According to court documents, the transvaginal mesh lawsuit at trial in West Virginia was filed by a woman who underwent multiple corrective surgeries after receiving C.R. Bard’s Avaulta Plus product in 2009. According to a report from Bloomberg News, she claimed that C.R. Bard knowingly used a plastic resin in those devices that was not fit to be permanently implanted in humans. The case was the first of four bellwethers scheduled in the multidistrict litigation underway in the Southern District of West Virginia for C.R. Bard vaginal mesh lawsuits. The second of those trials is scheduled to begin on Tuesday, August 19th. (In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2187)

This marks the third trial loss in a row for transvaginal mesh manufacturers, and the second loss for C.R. Bard. Last July, the company was ordered to pay $3.6 million to another victim of Avaulta Plus in a case that went to trial in California Superior Court. (Scott v. Kannappan, S-1500-CV-266034-WDE ) In March, the New Jersey Superior Court jury hearing the nation’s first trial of an Ethicon Inc. transvaginal mesh lawsuit awarded more than $11 million to a woman injured by the Gynecare Prolift device. (Gross v. Gynecare Inc., Atl-L-6966-10)

In addition to the C.R. Bard litigation, several other multidistrict litigations are pending in the Southern District of West Virginia for vaginal mesh lawsuits involving other device manufacturers, including:

  •     In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (MDL No. 2325)
  •     In re: Boston Scientific Corp., Pelvic Repair System Products Liability Litigation (MDL No. 2326);
  •     In re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation (MDL No. 2327)
