D. Miller & Associates PLLC Reports: First Mesh Bellwether Trial Successful, Plaintiff Awarded $2 Million

The first bellwether trial in the multidistrict litigation against transvaginal mesh manufacturer C.R. Bard, Inc. is complete, resulting in a $2 million verdict for plaintiff, Donna Cisson.

Donna Cisson, the first plaintiff to go to trial against C.R. Bard, Inc., manufacturer of the Avaulta product used to treat Cisson’s pelvic organ prolapse, was awarded $2 million by the jury. She received $250,000 in compensatory damages and $1.75 million in punitive damages.*

This trial was not the first for Cisson. Her first trial in July was declared a mistrial after a witness testified about Bard's removal of products from the market, something that was not allowed in the trial. Cisson's trial is just the first of several bellwether trials in this multidistrict litigation, the next of which began August 19th.

“This verdict is great news for the many other plaintiffs in the MDL. These women have suffered quite a bit and this verdict gives them a good chance at receiving the compensation they deserve,” says Darren Miller, founding attorney of D. Miller & Associates, PLLC.

A safety communication issued by the U.S. Food & Drug Administration in 2011 warned that serious complications associated with the surgical mesh used for treating conditions like pelvic organ prolapse were not rare.** In addition to pelvic organ prolapse, this mesh can also be used to treat stress urinary incontinence.

In conjunction with the C.R. Bard litigation, there are several other manufacturers of transvaginal mesh products currently involved in pending litigation for similar claims. They include: American Medical Systems, Inc., Boston Scientific Corp., Coloplast Corp., Cook Medical, Inc., and Ethicon, Inc.*** Each of these multidistrict litigations are also being presided over by U.S. District Judge Joseph Goodwin in West Virginia, the judge in the C.R. Bard cases.
