New York, NY (PRWEB) May 09, 2013
Debt Consolidation USA is happy with the announcement that the Assembly passed the recent consumer protection bill. Known as the Consumer Credit Fairness Act (A.2678/Weinstein), this bill seeks to protect consumers further against abusive debt collectors. The announcement was made by Assembly Speaker Sheldon Silver together with Judiciary Committee Chair Helene Weinstein and also Codes Committee Chair Joseph Lentol.
The bill was passed on April 22, 2013 and according to the Assembly’s press release, it sought to protect “working families, domestic violence victims, seniors and low-income” residents of New York State against bad collection practices of debt collectors.
The Assembly Speaker mentioned that this bill was passed because there was an “epidemic of unfair debt collection lawsuits” in the state. Most of the cases were aimed at consumers who are earning low to moderate salaries.
Among the specifics of the bill included the following:
1. The clerk of the court is required to mail the notice of pending consumer credit action to the defendant.
2. The court filing is required to contain more information regarding the debt (e.g. proof that the debt is owed to the plaintiff).
3. The statute of limitations of consumer credit transactions is now down to three years from the usual six. After the statute of limitations, once reached, will terminate the debt collectors ability to come after the debtor for the amount owed.
Debt Consolidation USA is one of the debt relief companies who are actively against abusive collection practices. In fact, they are campaigning debt relief options like debt management and debt settlement that both help screen consumers from collection calls. Based on their extensive experience with debt ridden consumers, the company admits that one of the leading causes of stress for their clients include collection calls. This is especially true for clients that are under severe financial difficulties.
This is why taking over collection calls is part of the service of this debt relief company. They understand that removing this stress will help the consumer focus on growing their debt payment fund and thus maximize their efforts to get themselves out of debt.
