C8 lawsuits alleging illness and wrongful death due to exposure to C8-contaminated drinking water continue to mount in a federal multidistrict litigation now underway in U.S. District Court, Southern District of Ohio, Wright & Schulte LLC reports. Court records indicate that three more C 8 lawsuits were transferred to the proceeding late last month. Prior to their transfer, the claims were originally filed on November 5, 2013 in U.S. District, Southern District of West Virginia. So far, at least 75 C8 lawsuits naming DuPont as a defendant have been filed or transferred to the Southern District of Ohio since the multidistrict litigation was established there this past April. According to court documents, all of the lawsuits allege that exposure to C8 tainted drinking water associated with DuPont’s Washington Works plant in Parkersburg, West Virginia caused people living and working in the area to develop serious illnesses, including kidney and testicular cancers, thyroid disease, inflammatory bowel disease (ulcerative colitis), preeclampsia (high blood pressure during pregnancy) and high cholesterol.
According to court documents, C8 is a chemical used to make Teflon, which for years was manufactured at the DuPont Washington Works facility. In 2005, DuPont reached a settlement in a C8 class action lawsuit that had been filed on behalf of 70,000 people who lived and worked in the vicinity of the plant. Among other things, the accord called for the creation of the C8 Science Panel and charged it with investigating potential links between exposure to the chemical and a number of serious illnesses. If the C8 Science Panel ultimately determined that there were any such links, the settlement stipulated that the residents of the Mid-Ohio Valley who were exposed to C8 contaminated water would be entitled to file an individual personal injury lawsuit against DuPont if they suffered from any of the illnesses identified by the panel.
