Dr. Rafik Benaissa Files a Complaint against Swiss Prosecutors before Canadian Courts, Alleges Cruel and Unusual Punishment of Brother in Swiss Prison

Dr. Rafik Benaissa, brother of former SNC Lavalin executive Riadh Ben Aissa, has filed a complaint against Swiss prosecutors before Canadian courts alleging his brother has been submitted to cruel and unusual punishment in a Swiss prison.

Dr Rafik Benaissa, brother of SNC Lavalin executive Riadh Ben Aissa and a member of the American Civil Liberties Union (ACLU), has filed a complaint against the Swiss Government and three Swiss Prosecutors before Canadian courts, alleging Riadh Ben Aissa has been submitted to cruel and unusual treatment at the Bern-Switzerland Regional Prison.

The complaint has been filed with both the Montreal Superior Court (# 500-17-080858-148) and the Canada Attorney General's Office in Montreal.

The complaint alleges the following nine points:

1-The complaint names the Swiss Confederation and Swiss Federal Prosecutors Mr. Michael Lauber, Mr. Nicolas Botinelli, and Mr. Olivier Thormann.

2-The complaint alleges that Riadh Ben Aissa has been submitted to cruel and unusual treatment by the Swiss Department of Justice and the above-named Swiss prosecutors, being locked in a prison cell with no windows 23 hours a day since April 10, 2012.

3-The complaint alleges that this cruel and unusual treatment could be in no way justified as Riadh Ben Aissa never represented a threat to society or to others. Furthermore, this cruel and unusual detention could not be justified by the alleged risk of flight from justice or collusion.

4-The complaint alleges that this cruel and unusual treatment by the Swiss government and the Swiss prosecutors was politically motivated and related to Riadh Ben Aissa’s alleged ties to the Kadhafi family.

5-The complaint alleges that Riadh Ben Aissa’s cruel and unusual treatment in a Swiss prison cell has been willfully ignored by Canadian officials, by members of the Canadian Federal Police, and by Canadian Magistrates, some of them having travelled to Switzerland to have access to Riadh Ben Aissa’s prosecution file.

6-The complaint alleges that the Swiss authorities have allowed RCMP agents to interrogate Riadh Ben Aissa at the Swiss prison when he was submitted to this cruel and unusual treatment.

7-Testimony to this cruel and unusual treatment before Canadian courts will be provided by American Psychiatrist Dr. Booker T. Evans who was able to interview Riadh Ben Aissa at the Bern-Switzerland Regional Prison on July 15 2013.

8-At least two employees of the Bern-Switzerland Regional Prison and one member of the Swiss Department of Justice will be subpoenaed before Canadian courts as all of them have openly expressed major concerns regarding Riadh Ben Aissa’s exceptionally abusive detention at the Bern-Switzerland Regional prison.

9-These alleged violations by the Swiss Department of Justice and the Swiss prosecutors were the subject of several complaints filed before Swiss Courts and the European Court of Human Rights (ECHR), and were already reported by Swiss Television channel RTS on May 28 2013.
