Dr. Larry Kawa announced today that on Wednesday, February 26, Rep. Mike Fitzpatrick (R-PA) will hold a press conference along with other members of Congress supporting a lawsuit filed on behalf of Kawa Orthodontics in an effort to force the administration to conform to the rule of law as it applies to the employer mandate (Kawa Orthodontics, LLP vs. Jack Lew, et al., (No. 9:13-cv-80990).
On October 1, 2013, Judicial Watch filed a lawsuit on behalf of Dr. Larry Kawa, a Florida Orthodontist, on the Presidential executive action canceling the congressionally approved ACA employer mandate for 2014 and 2015 (for large employers with between 50-99 employees). The lawsuit has recently been moved to the U.S. Court of Appeals for the 11th Circuit. The defendants in the case are the U.S. Department of the Treasury, the Secretary of the Treasury, the Internal Revenue Service and the Commissioner of the Internal Revenue Service.
This lawsuit is the only one of its type against any of the 29 executive orders regarding ObamaCare. This suit is specifically on the topic of the employer mandate, the largest of them all.
The Patient Protection and Affordable Care Act, also known as Obamacare, requires both employer and individual mandates to take effect in 2014. In early July of 2013, the Obama administration unilaterally delayed the employer mandate until 2015. Earlier this month, the Obama administration cancelled the employer mandate for businesses with 50-99 employees until January of 2016.
