According to a recent Justice Department press release, a company named EndoGastric Solutions, who manufactures and sells a device called EsophyX that is intended to treat gastroesophageal reflux disease was charged with overbilling the government. The device was allegedly developed as an alternative to a more invasive procedure that requires incisions in the abdomen. The government alleged that EndoGastric Solutions knowingly caused health care providers to bill for the less invasive EsophyX procedure using codes applicable to the more invasive procedure, which provided for a higher level of reimbursement. As a result, federal health care programs allegedly paid more than they should have for the procedures using EsophyX.
The government also alleged that EndoGastric Solutions knowingly paid illegal compensation to certain physicians for participating in patient seminars and co-marketing agreements to induce them to use EsophyX, which was in violation of the Federal Anti-Kickback Statute. In this instance the whistleblower will receive up to $945,000.
The Corporate Whistleblower Center says, "We believe kickbacks, and outright bribery in the medical device, or pharmaceutical industry is a growing problem. If an insider or medical doctor has extremely well documented proof of these types of practices, we would like to not only talk to them about reward programs, which can be extremely lucrative, but we would also like to explain that unlike any group in the US, we will assist a whistleblower in packaging their information, and we will get them in contact with one of the nation's top whistleblower attorneys." Simple rules for a whistleblower from the Corporate Whistleblower Center:
- Do not go to the government first, if you are a major whistleblower. The Corporate Whistleblower Center says, “Major whistleblowers frequently go to the federal government thinking they will help. Its a huge mistake. Frequently government officials could care less, or they are incompetent.”
- Do not go to the news media with your whistleblower information. Public revelation of a whistleblower’s information could destroy any prospect for a reward.
- Do not try to force a government contractor, or corporation to come clean to the government about their wrongdoing. The Corporate Whistleblower Center says, “Fraud is so rampant among federal contractors, that any suggestion of exposure might result in an instant job termination, or harassment of the whistleblower. We say, come to us first, tell us what type of information you have, and if we think its sufficient, we will help find the right law firms, to assist in advancing your information.”
The Corporate Whistleblower Center wants to emphasize there are high quality whistleblowers in every state including California, New York, Florida, Texas, Massachusetts, Maryland, Virginia, Ohio, Pennsylvania, West Virginia, Tennessee, North Carolina, Georgia, Alabama, Mississippi, Louisiana, Missouri, Michigan, Iowa, Indiana, Illinois, Wisconsin, Minnesota, North Dakota, Nebraska, Kansas, Colorado, Utah, New Mexico, Arizona, Nevada, Idaho, Oregon, Washington, and Alaska.
