Law firm Steinger, Iscoe & Greene announced a landmark victory of $11.1 million for the victim of a drunk driver Monday (Case No: 2010 CA 457 (Okeechobee)). Michael Steinger, founding partner of the firm, says it will not undo the man's injuries but will help him overcome them.
Rodney Wilde was riding his motorcycle in 2010 when he was hit by an out of control vehicle driven by Leroy Felt, according to CBS 12 News (retrieved 5/19/2014). Felt did not stop, and Wilde was dragged underneath his car for 200 feet before Felt sped away. Case No: 2010 CA 457 (Okeechobee)
Felt was later caught by police and was sentenced to five years in prison, but Steinger says that did nothing to help Wilde manage his injuries as stated in court documents.
"Rodney Wilde suffered massive brain damage, broken bones, and still has trouble walking four years later," Steinger said according to court documents. "He will be dealing with these injuries for life. This is what personal injury lawyers are for—to help victims get the support they need."
The accident was preventable, Steinger says. Felt had been drinking at the local Eagles Lodge for at least nine hours that day, and the Lodge allegedly never cut him off. When police caught Felt his blood alcohol level was nearly three times the legal limit as stated in court documents.
"He is a known alcoholic and the Lodge knew he was driving home," Steinger said. "Three times the limit means one fourth of a percent of all the blood in his body was pure alcohol; at that point a person is essentially disabled by alcohol." Case No: 2010 CA 457 (Okeechobee)
Wilde and his wife Charlotte asked Steinger, Iscoe & Greene to sue the Eagles Lodge for over-serving Felt, and they won. The $11.1 million award is one of the largest trial verdicts ever in Okeechobee County. Case No: 2010 CA 457 (Okeechobee)
"The Wildes can use this money to pay off medical bills, offset the loss of Rodney's income and get the physical therapy he needs," Steinger said.
Steinger believes the case sends a strong message to drinking establishments that they cannot over-serve customers.
"If you keep selling drinks when you know someone is drunk, you share responsibility for the outcome."
