It is illegal to promote drugs for off label uses. We are pleased with the settlement and continue to evaluate claims on behalf of families affected by birth defects allegedly linked to the ingestion of Paxil during pregnancy.
(PRWEB) June 27, 2014
GlaxoSmithKline agreed to pay $105 million to settle claims by California, New York, and more than 40 other states that it illegally promoted three of its antidepressants and asthma drugs, including Paxil(Bloomberg “Glaxo to Pay $105 Million to Settle Promotion Claims” June 2, 2014). In light of this news, Flood Law Group announces it is investigating potential Paxil claims.
According to the Bloomberg article, Glaxo is prohibited from providing incentive payments to salespeople that encourage uses not indicated on the drug labels. Glaxo also agreed to not provide any marketing materials that offer inaccurate information about its products. The agreement covers the depression drugs Paxil and Wellbutrin, as well as the asthma drug Advair.
“In 2012, the drugmaker pleaded guilty and paid $3 billion to resolve criminal and civil allegations that it pushed the sale of the antidepressant drugs for unapproved uses and failed to properly turn over clinical data on its Avandia diabetes drug,” the article states. “Glaxo also was forced to pay out more than $1 billion to settle lawsuits claiming company officials hid that Paxil could cause birth defects.”
National drug lawyers from Flood Law Group are evaluating possible claims on behalf of people affected by the decision to push sales of drugs for off label uses as well as for failures to disclose information about drug risks. The law firm also announces that it continues to investigate potential birth defect claims on behalf of women who took SSRI antidepressants while pregnant.
“It is illegal to promote drugs for off label uses,” said Christopher Brown, Director of Communications for the national personal injury law firm Flood Law Group. “We are pleased with the settlement and continue to evaluate claims on behalf of families affected by birth defects allegedly linked to the ingestion of Paxil during pregnancy.”
