Hill & Associates, P.C. reached a confidential settlement of $450,000 on behalf of Plaintiff, Margret Crowder.
Ms. Crowder, testified that she tripped and fell on a board in front of the Defendants' business when she was walking on the sidewalk. She further testified that she suffered a fracture of her fifth metatarsal in her left foot as well as a spiral fracture in her right ankle as a result of the December 20th accident.
It should be noted that the terms of the agreement require that the identities of the Defendants and the location of the accident remain confidential.
The Defendants contested liability in the case, asserting that the board was not theirs and neither they, nor their agents, had placed the board on the sidewalk. Defendants further alleged that the Plaintiff was prone to falls and negligent for failing to watch where she was walking.
Ms. Crowder further testified that the injuries to both of her lower extremities required surgical repair and continue to cause her discomfort. She is forced to use a cane to ambulate, significantly limiting her mobility despite having reached maximum medical improvement with respect to the injuries. The seriousness of the injuries and the continued mobility limitations ultimately led to the $450,000 settlement.
Upon the resolution of the case, lead trial attorney Susan B. Ayres expressed her satisfaction with the result saying, “The settlement of this contested liability case will allow our client, Ms. Crowder, to move forward with her life and continue the healing process.” Ms. Ayres also expressed the firm’s commitment to continue to represent injured persons.
