WHAT: Four Chicago residents (the “Plaintiffs”) have filed a lawsuit and are seeking an emergency preservation order against Megabus USA, LLC, and others (the “Defendants”), after Defendants’ passenger bus heading to Chicago and carrying dozens of people flipped over in Indiana.
WHEN: Lawsuit and emergency motion for preservation order were filed on October 15, 2014.
WHERE: Circuit Court of Cook County, Daley Center, Chicago.
WHY: At 4:25 a.m. on October 14, 2014, a Megabus crashed when the driver lost control of the bus on Interstate 65 in Greenwood, Indiana. The Megabus rolled and landed on its side, injuring many of the passengers.
The Plaintiffs were passengers on the Megabus, on their way home from the Chicago Bears’ victory over the Atlanta Falcons on Sunday in Atlanta, Georgia.
The Plaintiffs each suffered personal injuries, financial damages, and subsequent medical expenses. Some of their injuries include a separated shoulder, knocked-out teeth, and numerous facial cuts requiring stitches.
According to Thomas A. Zimmerman, Jr., counsel for the Plaintiffs, “The passengers reported hearing the bus driver complain that the windshield wipers were not working, and it was difficult to see the road in the rain. We suspect a malfunction in the windshield wipers prevented the bus driver from adequately seeing the road, and contributed to the crash.”
The Plaintiffs filed a lawsuit alleging the Defendants were negligent in maintaining and operating the bus. The Plaintiffs also filed an emergency motion for the entry of a preservation order from the Court, in order to preserve of all relevant evidence, including the Megabus itself.
