First C.R. Bard Transvaginal Mesh Lawsuit Settlement to Cost Device Maker Over $21 Million, The Oliver Law Group Reports
Detroit MI (PRWEB) October 23, 2014 -- C.R. Bard’s first large transvaginal mesh lawsuit settlement will cost the device maker more than $21 million, The Oliver Law Group P.C. reports. According to Bloomberg.com, the accord will resolve more than 500 of the 12,400 vaginal mesh lawsuits that have been filed against the company in U.S. courts, and provide an average of $43,000 for each participating plaintiff.

Court records indicate that the majority of claims pending against C.R. Bard have been filed in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia. In August 2013, that proceeding’s first trial of an Avaulta mesh lawsuit ended with awards of $250,000 in compensatory damages and $1.75 million in punitive damage for the plaintiff. According to Bloomberg.com, the federal judge overseeing the C.R. Bard mesh litigation recently ordered the company to ready 500 more cases for trial, which may have played a factor in its decision to settle some of the claims pending against it.

This is the second large vaginal mesh lawsuit settlement announced in recent weeks. Earlier this month, Endo International PLc disclosed an agreement to pay an additional $400 million to settle “substantially all” of the transvaginal mesh lawsuits pending against its American Medical Systems subsidiary. According to Bloomberg.com, that accord would pay each plaintiff an average of $48,000.

Court documents indicate that American Medical Systems is facing nearly 20,000 transvaginal mesh lawsuits, the majority of which are also pending in the Southern District of West Virginia. Earlier this year, Endo announced it had reached another agreement to pay about $830 million to settle thousands of additional American Medical Systems claims. In June 2013, the company also announced another transvaginal mesh settlement in which it would pay more than $54 million to resolve an undisclosed number of cases. Endo has not admitted liability in any of these matters.

According to court documents, more than 60,000 transvaginal mesh lawsuits have been filed in the U.S. District Court, Southern District of West Virginia by women who were allegedly injured by mesh devices used in the treatment of pelvic organ prolapse and stress urinary incontinence.
