By implementing 100% representation at all unemployment claim appeal hearings, the Unemployment Services Trust (UST) aims to provide support to nonprofit members during what can be considered a daunting procedure. Whether the hearing is in person or over the phone, local hearing representatives are now automatically assigned to each UST member employer when an unemployment claim decision is appealed and must go to the hearing level. With the goal of educating nonprofit employers on hearing procedures and improving hearing win rates—the results show it’s working.
UST’s historical data shows that, on average, nonprofit employers who attended a hearing without a hearing representative won only about 51% of the time. Often an employer’s loss is due to missing information and lack of familiarity with legal regulations.
Now, with support from local hearing representatives, UST nonprofit members are winning an average 7 out of 10 hearings.
Since each local hearing representative is familiar with the current state laws, the hearing process, and the proper evidence to provide, UST members are better prepared in advance of the hearing. In addition, the hearing representatives give any opening and closing statements so this burden is lifted off the employer.
“When a claim appeal reaches the hearing level, we’d like our members to feel both calm and prepared,” said Donna Groh, Executive Director of UST. “By helping our members prepare testimonials and organize documentation, these experienced hearing representatives have and will continue to win more appeals of improper unemployment claims—keeping more money in the nonprofit community.”

And with the added support of an online reporting system and dedicated claim representatives, UST members have been able to win 83% of protested improper claims overall.
