On December 2, 2015, the Los Angeles employment law lawyers at Blumenthal Nordrehaug & Bhowmik filed a class action lawsuit against Maplebear, Inc. "Instacart" on behalf of the company's Delivery Drivers alleging that the delivery service company devised an illegal scheme of classifying delivery drivers as independent contractors in order to avoid paying their share of payroll taxes, overtime wages, and other business related expenses. The class action lawsuit filed by the Los Angeles Labor attorneys alleges that Instacart hires workers to provide delivery services but claims that the company devised an unlawful scheme of classifying the delivery drivers as independent contractors in order to avoid paying for regular and overtime hours worked. Specifically, the class action complaint alleges that Instacart exercises complete control over the work performed and the manner and means in which the work is performed. The complaint claims that Instacart controls every critical aspect of their daily delivery operations in that the company allegedly provides the customer, the list of items to be picked up and delivered, and instructions to its delivery drivers as to where to deliver the goods and deadlines for delivery.
