The Fourth of July holiday is approaching, and along with it, the great possibility that motorists will encounter a law enforcement “DUI checkpoint,” or roadblock. Florida criminal and DUI defense attorneys Darren Finebloom and David Haenel of Finebloom, Haenel & Higgins weigh in on the rights of drivers when it comes to a police roadblock.

“DUI checkpoints or roadblocks can be a common occurrence on holidays such as Independence Day,” says DUI defense attorney Darren Finebloom. “It’s a time when law enforcement officers ask drivers to stop, and if the driver is determined to have any sign of impairment (such as even an odor of alcohol on their breath), they may be asked to further submit to field sobriety or even breathalyzer tests to see if they are driving under the influence.”

Officers may block off a heavily traveled road and check cars randomly to search for drivers who they believe to be impaired. To protect the rights of citizens under the Fourth Amendment of the Constitution, police must follow strict guidelines when conducting a roadblock, as the Florida Supreme Court has ruled that these checkpoints are “seizures.”

“Citizens have rights when it comes to police DUI checkpoints,” says criminal defense lawyer David Haenel. “And in the event of an arrest, it is extremely important that they know what their rights are, and how the laws of the State of Florida pertain to their arrest.”
