DePuy Orthopaedics recalled its unused custom hip and knee replacement implants after the FDA notified the company of safety concerns.

A DePuy recall was issued on August 24, 2012 by the Johnson & Johnson subsidiary, Bernstein Liebhard LLP reports. This latest recall involves all unused units of its custom orthopedic implants. The DePuy recall was issued in response to a request made by the U.S. Food and Drug Administration (“FDA”). Specifically, DePuy Orthopaedics recalled its unused custom hip and knee replacement implants after the FDA notified the company of safety concerns.* Previously, in January 2012, DePuy discontinued the line of custom devices after receiving a warning letter from the FDA. “Although the devices’ size and shape may vary with each patient’s anatomy, the standardized design characteristics do not vary among the devices manufactured,” the December 8, 2011 FDA letter stated. “The fact that final specifications are tailored to match a patient’s anatomy does not preclude a clinical study or submission of a marketing application for the devices.” Further, the FDA warning letter noted that the devices were sold without testing and cited poor quality control procedures. More than 8,300 of the custom implants have been sold since 1999, although it is unknown how many unused custom implants are being recalled.
Previous DePuy Recall Subject Of Mounting Hip Replacement Lawsuits
This is not the first DePuy recall involving hip replacement devices. In August 2010, the company issued a recall of its ASR hip replacement devices after data showed that the devices had excessively high failure rates often requiring patients to undergo revision surgery to remove the defective implants. Approximately 2,000 additional DePuy ASR hip recall lawsuits have been filed in state courts nationwide. The first federal DePuy ASR hip recall lawsuit trial is scheduled to begin on May 6, 2013 with the second trial set for July 8, 2013.**
