Ethicon lawsuits filed by women who claim they were injured by the company’s transvaginal mesh products are moving forward. On August 31, 2012, Ethicon, Inc. filed its Answer to the First Master Amended Complaint in the federal Ethicon transvaginal mesh multidistrict litigation, now underway in U.S. District Court, Southern District of West Virginia. Ethicon, a division of Johnson & Johnson, faces hundreds of transvaginal mesh lawsuits in the litigation, Bernstein Liebhard LLP reports. According to the Answer filed with the Court, a number of the company’s mesh products are named in the Ethicon lawsuits, including Prolene Mesh/Prolene Soft Mesh, Gynemesh, Gynemesh PS, TVT, TVT-Obturator, TVT-SECUR, TVT Exact, TVT Abbrevo, Prolift, Prolift + M, and Prosima vaginal mesh products. “We continue to receive inquiries from women on a daily basis who have allegedly sustained horrific injuries following implantation of Ethicon mesh, as well as transvaginal mesh products marketed by other manufacturers,” says Bernstein Liebhard LLP, a nationwide law firm representing clients who have been injured by dangerous drugs and defective medical devices, including Ethicon mesh. Transvaginal Mesh Lawsuits
Ethicon mesh products and other transvaginal mesh devices have been under increasing scrutiny in recent years, as more and more women have reported painful complications following transvaginal placement of surgical mesh for the treatment of pelvic organ prolapse and stress urinary incontinence. In 2011, the U.S. Food & Drug Administration (FDA) warned that between 2008 and 2010, it had received more than 1,500 reports of transvaginal mesh problems after pelvic organ prolapse repair surgery, including erosion of the mesh into the vagina, contraction or shrinkage of the mesh, infection, pelvic pain, urinary problems, vaginal scarring and other complications. The FDA characterized these problems as “not rare.”**
In addition to Ethicon lawsuits, several other large transvaginal mesh litigations are currently pending in the Southern District of West Virginia, including In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); and In re: C.R. Bard, Inc., Pelvic Repair System Products Liability Litigation (“MDL No. 2187”).
