In a recent case in Manatee County, Florida DUI defense lawyer AnneMarie Rizzo of the law firm Finebloom, Haenel & Higgins successfully convinced prosecutors to reduce felony DUI with serious bodily injury charges against her client and allow him to plea to misdemeanor DUI charges.
According to court documents, the driver was involved in a motor vehicle accident in which his car struck a motorcycle. During the crash investigation by the Florida Highway Patrol, the trooper noticed signs which he believed pointed to the driver being under the influence of alcohol to the extent that his normal faculties were impaired. Because the motorcyclist was seriously injured in the accident, the trooper forced a blood draw on the driver. He was not arrested at the time of the accident, pending the results of the blood alcohol test.
After the accident, the driver contacted and hired DUI defense lawyer AnneMarie Rizzo of Finebloom, Haenel & Higgins for representation in his pending case. If arrested, this would be his third DUI offense within a 10-year period, which carries a felony charge and prison time. When the blood test results returned from the FDLE showing a 0.121 blood alcohol level (over the legal limit), Ms. Rizzo contacted the prosecutor’s office to avoid a formal arrest of her client and to negotiate a deal in her client’s best interest.
After gathering all the evidence, attorney Rizzo presented legal defenses to the prosecutor and was able to persuade them to allow her client to plead to misdemeanor DUI. The client avoided arrest and a felony conviction, and did not have to spend any time in jail.
