In a decision of interest to New York civil rights violation lawyers at The Perecman Firm and other defenders of civil rights, a New York state appeals court ruled that board members at The Dakota can be personally sued for alleged racial discrimination.
According to the lawsuit (Fletcher v. The Dakota, Inc., 101289/11), the board’s rejection of a prominent hedge fund manager's attempt to double the size of his apartment may constitute racial bias, a civil rights violation.
Alphonse "Buddy" Fletcher, an African-American, sued the famous building and individual board members in 2011. He claimed the board had turned down his offer to buy an adjoining apartment because of his race. According to the civil rights violation lawsuit, Fletcher alleged discrimination under New York State and City human rights laws.

“No one can refuse to sell or rent housing to someone because of their race or color. Conditions of a rental or sale cannot be changed either because of someone's race or color in New York,” Perecman said.
