A New York lesbian couple claimed they were turned away from a potential wedding venue because they are gay. The discrimination complaint against the owners of Liberty Ridge Farm is the first of its kind since New York legalized same-sex marriage, according to Reuters. Marriage should be about love, not discrimination, said New York civil rights violation lawyer David Perecman, founder of The Perecman Firm.
The farm owners allegedly told Jennie McCarthy and Melisa Erwin they could not hold their wedding on the property after learning it would be a same-sex wedding. The owner, Robert Gifford, said he would not host any gay marriages at Liberty Ridge because he and his wife object to same-sex marriage on religious grounds, said Reuters.
Under New York State law, it is generally illegal for a business to discriminate on grounds of sex, race or sexuality. There are exceptions for certain religious institutions and membership organizations. The farm doesn’t fall under any exempt categories, said Reuters.
“Marriage equality is a reality in New York. Businesses need to respect these relationships and put an end to discrimination against same sex couples or they may find themselves facing a civil rights violation lawsuit,” said Perecman, a civil rights violation lawyer in New York for over 30 years.
Same-sex marriages were legalized in New York in July 2011.
New York’s Sexual Orientation Non-Discrimination Act (SONDA) made it illegal for anyone to be discriminated against in employment, housing, credit, education and public accommodations because of their real or perceived sexual orientation. It was signed into law in 2002.
