The first complaint was filed in the Superior Court of the State of California for the County of Orange (Case No. 30-2015-00824021-CU-WT-CJC) on behalf of two female plaintiffs who worked at Stella’s Serious Italian Restaurant in Dana Point, CA. According to court documents, a male co-worker, who works as head chef, allegedly repeatedly harassed the plaintiffs verbally and physically over the course of a year.
According to court documents, the two plaintiffs were allegedly subjected to frequent, offensive and unwanted touching of their bodies by the defendant. The complaint states that the plaintiffs repeatedly objected to this harassment and on numerous occasions complained to management, but allegedly nothing was effectively done to end the harassment, and the plaintiffs were required to continue working with the defendant.
As a result of the plaintiffs’ complaints, according to court documents, an employee meeting was held where management allegedly stated that he knew sexual harassment was a problem and that it would be grounds for termination. However, court documents state nothing changed after the meeting and the defendant continued to allegedly sexually harass the plaintiffs and retaliate against one of them.
The second complaint was filed in the Superior Court of the State of California for the County of Orange (Case No. 30-2016-00829612-CU-OE-CJC ) on behalf of a woman who was eighteen years old when she was hired at an Albertsons in Orange County. According to court documents, shortly after the plaintiff was hired, she was subjected to offensive sexual harassment by a male manager, in the form of sexual comments about her appearance and her body, details about his sex life and other sexual comments. The complaint alleges that the plaintiff made multiple written complaints about the harassment, and the plaintiff’s mother even came into the store and spoke to the Assistant Store Director. The complaint alleges that the plaintiff continued to be harassed after her complaints, and she suffered panic/anxiety attacks at work, including one where she had to go to the emergency room. According to court documents, after the plaintiff allegedly threatened legal action, the company transferred the alleged harasser to another store rather than fire him. The manager allegedly has been transferred by the company from store to store, on multiple occasions, because of sexual harassment complaints.
