Thousands of Actos lawsuits filed on behalf of individuals who allegedly suffered bladder cancer due to long –term use of the type 2 diabetes drug continue to move forward in the U.S. District Court, Western District of Louisiana, Bernstein Liebhard LLP reports. According to a Minute Entry posted on the Court’s website on April 17th, the litigation’s next Status Conference is scheduled for April 25th. Among other things, the Conference will address the status of federal and state Actos bladder cancer filings, as well as the status of the bellwether trial nomination process. Actos Bladder Cancer Lawsuits
Court records indicate that Takeda Pharmaceuticals has been named in more than 3,000 Actos bladder cancer lawsuits, most of which are pending in the Western District of Louisiana. All of the Actos lawsuits allege that users of the drug face an increased risk of developing bladder cancer. Plaintiffs also accuse Takeda and other defendants of concealing their knowledge of that risk and failing to provide adequate warnings to the public and medical community.
Last week, a Los Angeles Superior Court jury heard closing arguments in the nation’s first trial of an Actos bladder cancer trial. According to a Bloomberg.com report, evidence introduced at trial included internal Takeda emails that suggested company officials were worried about the impact an Actos bladder cancer warning would have on sales of the drug. Documents unsealed ahead of the trial also indicate Takeda secretly surveyed a dozen doctors in 2003 to see if they would prescribe a diabetes drug that carried a warning about the potential for bladder cancer. Plaintiff’s attorneys assert the survey found that a bladder cancer warning would destroy the sales of Takeda’s most important drug, Bloomberg said.* (Cooper v. In June 2011, the U.S. Food & Drug Administration (FDA) ordered Takeda to add new warnings to the Actos label, after a study found that long-term use of the drug increased the risk for bladder cancer.** Since the FDA issued its alert, the evidence tying Actos to an increased risk of bladder cancer has only grown. Most recently, a study published in the British Diabetic Association journal, “Diabetic Medicine,” found that the risk of bladder cancer was significantly higher in patients using Actos compared with control groups.***
