Thousands of Actos lawsuit claims alleging bladder cancer continue to move forward in the federal litigation now underway in the Western District of Louisiana, Bernstein Liebhard LLP reports.

According to a calendar update posted on the court’s website, the next Status Conference in the proceeding is scheduled for June 20th, 2013.* Lawsuits filed in this litigation have been brought by plaintiffs who allege long-term use of the type 2 diabetes drug caused their bladder cancer.

Among other matters, the upcoming Conference will discuss the status of state and federal Actos lawsuit claims, the status of discovery and impending bellwether trials in the litigation. The first trial in the federal Actos bladder cancer litigation will begin in January 2014, court records indicate. (In re: Actos Product Liability Litigation, MDL No. 2299)

Actos Lawsuits
As of May 2013, more than 1,500 Actos lawsuits alleging bladder cancer were pending in the federal proceeding underway in the U.S. District Court, Western District of Louisiana. The update on the number of filings in the litigation, which was established in December 2011 after the U.S. Food and Drug Administration (FDA) warned the public that long-term use of the medication may increase a patient’s risk for developing the disease, was presented at a Status Conference held on May 23rd.**

According to court documents, the first bellwether trial for the Actos bladder cancer litigation is slated to begin on January 27, 2014, and the second will begin on April 14, 2014.

In addition to suits pending in the federal Actos bladder cancer litigation, a May 1st
Bloomberg.com report stated that numerous claims have been filed in consolidated litigations established in Illinois and California as well.*** All cases filed over Actos allege its manufacturer, Takeda Pharmaceuticals, failed to adequately warn doctors and patients about the drug’s potential to cause or worsen bladder cancer.

Patients who developed bladder cancer after taking Actos for a long period of time may be eligible to receive compensation for medical expenses, lost wages, pain and suffering and other damages incurred by their injuries.
