According to court documents, thousands of Actos lawsuits filed by plaintiffs who developed bladder cancer while using the popular type-2 diabetes drug continue to move forward in the U.S. District Court, Western District of Louisiana, Bernstein Liebhard LLP reports. The judge overseeing Actos bladder cancer lawsuits in the Western District of Louisiana has scheduled the litigation’s next Status Conference for March 21st. Court documents indicate that Takeda Pharmaceuticals is facing more than 3,000 Actos bladder cancer lawsuits, most of which are pending in the federal Actos litigation. The proceeding’s first Pilot Bellwether trial will begin on January 27, 2014, while the second will commence on April 14, 2014. The nation’s first trial involving an Actos bladder cancer lawsuit is currently underway in Los Angeles Superior Court. (Cooper v. In June 2011, the U.S. Food & Drug Administration (FDA) ordered Takeda to add new warnings to the Actos label, after a study found that long-term use of the drug increased the risk for bladder cancer.* Since then, thousands of Actos users have filed Actos bladder cancer lawsuits alleging Takeda failed to provide adequate warnings to patients and doctors about its link to the disease. According to a recent Bloomberg report, court papers filed in the Actos lawsuit underway in Los Angeles show Takeda Pharmaceuticals secretly surveyed a dozen doctors in 2003 to see if they would prescribe a diabetes drug that carried a warning about the potential for bladder cancer. Plaintiff’s attorneys assert the survey found that “a bladder cancer warning would destroy the sales of Takeda’s most important drug.”**

Earlier this week, a clinical pharmacologist testifying as an expert for the Plaintiff asserted that internal Takeda emails indicated the company was more concerned with profits than patient safety when officials discussed adding bladder cancer warnings to the Actos label. According to Bloomberg.com, the emails referenced by the witness included one from 2005 in which Takeda officials discussed whether regulators might seek warning labels about Actos’ association with bladder cancer. “Actos is the most important product for Takeda and therefore we need to manage this issue very carefully and successfully not to cause any damage for this product globally,” a Takeda executive wrote. Such a development would be a “worst case scenario,” and he urged colleagues to seek a “positive outcome” from “regulatory authorities.”***
