Alabama accident lawyer Mike Slocumb weighs in on a recent hit-and-run collision in which a Birmingham pedestrian was hit by a car, according to a news report.

A middle school student was struck while walking on the sidewalk in Birmingham by a driver who jumped the curb, ran into the 13-year-old pedestrian and then fled the scene, according to the Alabama CBS affiliate, on Jan. 29. “Pulling over after hitting someone might seem like common sense, but it’s not unusual for someone in Alabama to flee the scene. A driver who fails to stop after hitting someone or hitting another vehicle is breaking the law and needs to be held accountable,” Slocumb said.

According to news reports, the private school student in Birmingham was hit by the car while walking on the sidewalk. The Channel 13 report quoted police who said the driver of the car then fled the scene of the accident, but was later caught by police on a nearby highway exit. According to the report, the boy was not seriously injured.

Birmingham car accident attorney Slocumb said hit-and-run-accidents can be complicated car crash cases because they add a criminal element to the equation. “Make no mistake, a hit and run accident is a criminal act,” Slocumb said. “There is never a legitimate reason to fail to stop after being involved in a collision. Often, drivers flee because they are driving under the influence. They may hit and run because they lack valid auto insurance or an operator's license, or they may have a warrant out for their arrest.”

The CBS affiliate’s report said that the hit-and-run driver could be facing three charges including, second degree assault, duty to remain on the scene of an accident, and reckless endangerment. He was being held in the Birmingham City Jail.

Slocumb said he urges all drivers to be aware of the increasing driver distractions that car makers come out with every year due to advancements in dashboard technology.

Slocumb said any number of distractions, from texting while driving to looking at a GPS for directions, can result in a serious accident. “Even if you look at a cell phone for a few seconds, you are putting your own life and the lives of everyone else on the road at risk,” Slocumb said. “I encourage all drivers to drive safely and avoid distractions.”
