According to the 15th Civil Court of the Judicial District of Curitiba - Paraná (State)- Brazil (15ª Secretaria do Cível de Curitiba, Estado do Paraná, Brazil), on the morning of June 25th 2010, TSW Alloy Wheels together with their legal team and Brazilian authorities conducted a raid of three facilities owned by GISA SPORT WHEELS and Japan Pneus and in Brazil. With reference to case number 0029182-90.2012.8.16.0001 and according to court documents, TSW was granted an injunction against Japan Pneus and GISA for manufacturing and selling replica TSW wheels.
According to court documents, after four months of investigation into the infringement activities of GSW GISA Sport Wheels and Japan Pneus, TSW obtained a court order to seize the GSW wheels from 3 different locations. These companies had allegedly infringed upon the TSW trademark and had been manufacturing replicas of TSW wheel designs and had been selling these wheels under the GSW brand name. They were also using a logo that was visually almost identical to the TSW logo.
According to court documents, the defendants were prohibited from using the GSW trademark under a penalty of $5000 per day. Twenty different models of GSW wheels were identified as infringing the TSW trademark and have been seized.
Terence Scheckter, president of TSW Alloy Wheels stated, “We will not allow other parties to infringe upon TSW trademarks and steal our intellectual property.” TSW is pursuing damages from infringing entities.
