Atlas Chalet Shingles are Defective and Deteriorating Prematurely, Alleges Class Action Lawsuit Filed by Parker Waichman LLP

Parker Waichman LLP has filed a class action lawsuit on behalf of consumers who have purchased Atlas Chalet Shingles. The lawsuit alleges that the products are defective and fail to live up to the claims of the manufacturer, Atlas Roofing Corporation.

Parker Waichman LLP, a national law firm dedicated to protecting the rights of consumers, has filed a class action lawsuit alleging that Atlas Chalet Shingles are defective and fail to comply with the manufacturer’s claims (0:13-cv-01505-TLW). The suit was filed on June 3, 2013 in the U.S. District Court for the District of South Carolina, Rockhill Division. Atlas Roofing Corporation has been named as the Defendant.

The lawsuit was filed on behalf of a South Carolina couple and all others who are similarly situated. According to the class action Complaint, Atlas marketed its Chalet Shingles as being durable, reliable, and compliant with ASTM standards appropriate for use in homes and other structures. The suit alleges that the shingles did not perform as marketed. Allegedly, Atlas also told Plaintiffs that the products would be free of defects for at least 30 years, and that it would remedy the situation if the shingles failed to live up to these standards. The lawsuit alleges that Atlas knew its Shingles were defective, causing

  • Blistering
  • Granule Loss
  • Increased Moisture Absorption
  • Reduced Life Expectancy

Allegedly, the Shingles are so defective that Plaintiffs in the class have to repair or replace the Shingles sooner than reasonably expected. According to the Complaint, the products fail to satisfy industry standards. Therefore, the suit alleges, the Chalet Shingles have not lived up to Atlas’ representations and warranties, and consumers are entitled to compensation.

According to the Complaint, this class action asserts breach of express warranty, breach of implied warranty, three counts of negligence (negligence, gross negligence, and negligent design), strict products liability and fraudulent concealment.
