Barry Law Group lead attorney Carl Barry has filed a lawsuit in the alleged wrongful death of Roland Pearce, a 62-year-old Odessa man whose car was struck head-on by an out-of-control vehicle, according to court documents.
The Austin car accident attorney filed the lawsuit on behalf of Pearce’s estate and his sister in the 358th Judicial District Court of Ector County, Texas, cause number D-134,547, in order to help pay the medical bills Pearce incurred while undergoing multiple operations to save his life. Fifty days after the accident, Pearce succumbed to his injuries.
According to the petition, the defendant, an oil field services manager, was driving a company pickup truck when he lost control of the vehicle. The out-of-control vehicle then swerved across several lanes of traffic to strike Pearce’s vehicle.
“My client has faced an awful tragedy,” Barry said. “The pain she is facing right is indescribable. This tragedy should never happen to anyone. She’s lost her brother and now she is left with hundreds of thousands of dollars in medical bills. Somebody has to pay for this tragedy.”
According to the petition, the plaintiffs allege that the defendant operated the vehicle in an unsafe and improper manner by driving too fast for the existing conditions.
