Biomet hip lawsuits (http://www.consumerinjurylawyers.com/biomet-magnum-hip-replacement) continue to move forward in a multidistrict litigation underway in U.S. District Court, Northern District of Indiana, Bernstein Liebhard LLP reports. According to an Order dated October 9, 2013, the Court is considering the appointment of a special discovery master and the issuance of a scheduling order. Among other things, the Order directs Plaintiffs’ attorneys to submit a proposed form of order that would appoint a special master and establish a scheduling order covering events to the point of trial readiness of the first bellwether trial by October 25, 2013. Biomet Hip Replacement Allegations
According to court records, all of the Biomet hip replacement lawsuits pending in the Northern District of Indiana involve the Biomet M2a Magnum Hip Replacement System. Plaintiffs allege that its metal-on-metal design, which consists of a ball and cup made from a chromium cobalt alloy, can cause the hip to shed dangerous amounts of metal debris leading to serious and debilitating complications, premature failure of the device, and revision surgery to remove and replace the implant. Court documents indicate that more than 650 Biomet hip lawsuits are currently pending in the federal litigations.
In January 2013, the U.S. Food & Drug Administration (FDA) issued an advisory on metal-on-metal hip replacements, warning that they had been associated with higher rates of early failure compared to those made from other materials. The FDA has advised recipients of all-metal hips to undergo metal ion blood testing if they experience any symptoms that would indicate their device could be failing. The agency has also proposed new regulations that would subject such implants to more regulatory oversight.
