The federal court overseeing hundreds of Biomet hip lawsuits (http://www.consumerinjurylawyers.com/biomet-magnum-hip-replacement) involving the M2a Magnum Hip Replacement System has issued a new Scheduling Order setting forth deadlines pertaining to a number of matters, including the proceeding’s bellwether trials, Bernstein Liebhard LLP reports. Among other things, the December 10th Order directs the parties to identify three Biomet hip replacement lawsuits as bellwether trial candidates by February 7, 2014. The Court could schedule as many as five trials, which will most likely be held in June, August, October, and December of 2015 and January 2016, the Order states. Biomet Hip Replacement Lawsuits
Court documents indicate that nearly 800 Biomet hip lawsuits are now pending in the federal litigation underway in U.S. District Court, Northern District of Indiana. Plaintiffs in these lawsuits allege that the metal-on-metal design of the M2a Magnum can allow dangerous amounts of toxic metal ions to accumulate in the tissue and blood stream of recipients. The lawsuits further allege that this can cause debilitating complications, including metallosis, chronic pain, and loss of mobility, which often require Biomet hip replacement patients to undergo revision surgery to remove and replace the implant.
According to a safety communication issued by the U.S. Food & Drug Administration in January, metal-on-metal hips may be more likely to fail within several years of surgery than those made from other materials. Patients implanted with these types of hip implants have also been advised to seek medical attention if they experience any symptoms that could indicate their artificial hip may be failing prematurely.
