Biomet Hip Replacement Lawsuit
According to court documents, 1,141 Biomet hip lawsuits are currently pending in the Northern District of Indiana. All of the lawsuits similarly allege that recipients of the metal-on-metal M2a Magnum hip system suffered metallosis, pseudotumor formation, early device failure and other serious complications due to its propensity to shed dangerous amounts of toxic metal ions into patients’ tissue and blood stream. On February 3, 2014, U.S. District Judge Robert L. Miller, Jr. approved the Biomet hip replacement settlement, which could resolve hundreds of claims filed in the proceeding.
To participate in the settlement program, plaintiffs must file their Biomet hip lawsuits no later than April 15, 2014. According to court documents, plaintiffs who received one of the affected Biomet hip replacements as part of an initial surgery that was rectified more than 180 days after it was implanted will be eligible for a base award of $200,000.
The Biomet M2a Magnum hip system is a metal-on-metal hip implant, a class of devices that is currently being reviewed by the U.S. Food & Drug Administration (FDA). In January 2013, the agency recommended that all-metal hip recipients undergo blood testing for elevated levels of metal ions if they experience any symptoms that would indicate their hip is failing. The FDA has also proposed new regulations that would subject all-metal hips to greater premarket testing, and which also require the manufactures of devices already on the market to conduct safety studies of those products in order to continue selling them.
