Bernstein Liebhard LLP announces that they have filed a Biomet hip replacement lawsuit on behalf of a recipient of the Biomet M2a Magnum hip implant. The complaint was filed on March 1st in the multidistrict litigation established in U.S. District Court, Northern District of Indiana for all federally-filed Biomet hip implant lawsuits. Court records indicate that at least 141 claims are currently pending in the federal Biomet M2a Magnum hip implant litigation. Last month, the Court issued a Case Management Order allowing Biomet hip replacement lawsuits to be filed directly in the Northern District of Indiana. Biomet Hip Implant Lawsuits
The Biomet M2a Magnum Hip is a metal-on-metal hip implant system, in which the ball and cup consist of a chromium/cobalt alloy. Like other claims pending in the federal litigation, the Biomet hip replacement lawsuit filed by Bernstein Liebhard LLP alleges the all-metal design of the M2a Magnum can generate high levels of metal ions, leading to metallosis in the surrounding tissue and early failure of the device.

The safety of the Biomet M2a Magnum and other metal-on-metal hips is currently being reviewed by the U.S. Food & Drug Administration (FDA). On January 17, 2013, the agency issued new guidance for patients with metal-on-metal hips, advising doctors to consider metal ion testing if patients are experiencing symptoms of hip implant failure. The FDA has also proposed a new regulation that would make all-metal hips ineligible for its 510(k) approval system, which allowed products like the Biomet M2a Magnum hip implant to come to market without human testing.*

Biomet is just one of several manufacturers that have been named a defendant in product liability claims involving metal hip replacements.
