Boca Raton Lawyer Brian M. Moskowitz Applauds Article for Showing How No Details Can Be Overlooked in a Divorce

The founder of The Law Offices of Brian M. Moskowitz reacts to a recent Orlando Sentinel article by pointing out how changing one’s legal name is just one of the many matters, big and small, that need to be addressed while going through a divorce.

It just goes to show that divorces require paying attention to all of the details, whether they are big or small.

Brian M. Moskowitz, a marital and family law attorney serving Boca Raton and surrounding areas, said no divorced woman should wait until after a divorce to change her legal name and pay the $400 cost – as described in a recent Orlando Sentinel article.

“Many women who go through divorce decide to take back their maiden name, which they can do for free in Florida while their divorce case is open,” said Moskowitz, founder of The Law Offices of Brian M. Moskowitz. “It’s only if you wait until after the divorce that a new filing fee and possibly additional attorney’s fees come into play.

“It just goes to show that divorces require paying attention to all of the details, whether they are big or small,” he continued. “Whether it’s changing your name, beneficiaries on retirement accounts or collecting evidence about your marital assets and liabilities, you’ve got to focus on every one of those details – or else it could come back to haunt you.”

The recent Orlando Sentinel report explained how Florida’s $400 name change fee is waived while divorce cases are open.

“But many times, overwhelmed by the myriad decisions that come with dissolution of marriage, [divorcing women] put the name change on the back burner, figuring it can happen anytime,” the newspaper said. The result: They have to file a name-change petition and pay the associated costs.

Moskowitz agreed that a name change may not seem to be the most pressing issue on a person’s mind in the middle of a divorce. But, he said, it is the divorce attorney’s job to keep up with the name change and other matters as the divorce progresses.

“An experienced divorce attorney will know when to present this and many other issues to a client and make sure every one of them is dealt with before the case concludes,” Moskowitz said. “We want our clients to focus on their lives. We’ll focus on the details.”
