The accident occurred on June 6, 2011, when a van driven by an Atlanta Refrigeration Service Co. employee failed to yield before making a left turn according to court documents. The car’s driver slammed on the brakes and tried to avoid the van but collided with it after veering to the right. An ambulance took the plaintiff to Gwinnett Medical Center, where she was treated for a broken right arm in between her elbow and her shoulder. In Gwinnett State Court before Chief Judge Robert Mock, Sr., the Defense brought an expert collision reconstructionist who claimed that the crash was not their driver's fault. Although the jury did find that the driver of the victim's vehicle had some responsibility, the jury found the driver majority responsible for the crash and his company and insurer bore the lion's share of the verdict.
“The employee had a history of unsafe driving practices,” said Simon. “When someone exhibits unsafe driving habits for a prolonged period of time, accidents are bound to happen.”
The jury award more than covers the $58,000 in medical expenses accrued by the plaintiff. "It was a challenging case from a demographic perspective" said Simon. There were 9 minorities in the 30-person jury pool. Four of these were struck because they did not speak English very well. The other five were struck by the defendant’s attorney. The upper middle class and all-white composition of the jury proved challenge for the legal team representing the plaintiff because there were 3,200 social media posts made by the Plaintiff in the year after the crash that gave a rose-colored glasses perspective impression on how well she healed up. "22 year old urban young people speak with a vocabulary that is foreign to a conservative, suburban jury so building rapport was challenging," continued Simon. "The takeaway from this trial is to be cautious about your social media posts as they can paint you in an unintended light, even when you are truthful."
