In a landmark ruling announced yesterday, the Italian Supreme Court said that cell phone radiation can cause brain cancer, finding a causal link between a man’s heavy cell phone use and a brain tumor he developed.* The judicial finding that cell phones can cause brain cancer is backed by a growing body of research that suggests long-term exposure to cell phone radiation increases the risk for brain tumors, according to Bernstein Liebhard LLP.

Last year, the World Health Organization’s International Agency on Research for Cancer classified cell phone radiation as possibly carcinogenic to humans after the Interphone study found that using cell phones for typically only 30 minutes per day or more resulted in a 40% increased risk for a type of brain tumor called glioma, when compared to someone who had not used a cell phone. If the phone is used mostly on one side of the head, the risk is 96% more than someone unexposed to cell phone radiation, according to the study.**

On June 15, 2012, the Federal Communications Commission (FCC) submitted a proposal to reevaluate cell phone radiation emission standards, something it has not done since 1996*** On August 7, 2012, a report from the U.S. Government Accountability Office (“GAO”) found that FCC cell phone radiation standards are outdated compared to standards of international regulatory agencies. The current levels may fail to reflect the most recent research on cell phone radiation, and may not identify the maximum exposure that most users are subject to, the report said.****
