[Y]ou can’t go into the claims process hoping that you get the right examiner. Instead, you have to go into the process knowing that you have the right attorney by your side.

A newly released study underscores the importance of getting legal help when filing for benefits, Chicago Social Security disability attorney Lawrence Disparti said today.

Nicole Maestas, a RAND Corp. analyst, told the House Ways and Means Social Security subcommittee March 20 that a study by the think-tank found that the rate of approval for initial Social Security Disability Insurance (SSDI) claims appeared to depend on which examiner reviewed the application, according to the online journal, LifeHealthPro.

A RAND analysis revealed that as high as 60 percent of the claims it reviewed may have received different results if they had been assigned to a different examiner.

“To me, this study clearly indicates that SSDI applications are treated inconsistently by examiners,” said Disparti, founder of the Disparti Law Group. “That means you can’t go into the claims process hoping that you get the right examiner. Instead, you have to go into the process knowing that you have the right attorney by your side.

“An attorney can help make sure your application is thoroughly prepared, which improves your chances of being approved,” he said. “An attorney can also aggressively protect your interests if you need to appeal a decision.”

The Chicago Social Security disability benefits lawyers of Disparti’s firm help clients in Illinois and across the country to secure SSDI benefits as well as Supplemental Security Income (SSI) benefits.

Disparti said SSDI applications can be daunting. Also, hearings are governed by complex rules and regulations.

“Applicants may have to go through multiple levels of appeals to secure the SSDI benefits they need,” Disparti said. “And for most people, that’s a lot to take on.”

He said obtaining the help of an experienced Chicago SSDI attorney can be the best way to ensure a successful claim.

“The attorneys of the Disparti Law Group pursue SSDI claims every day, for instance, so we know the process thoroughly,” he said. “The bottom line is that it shouldn’t matter which examiner looks at your case. If you are assisted by an attorney, you will find yourself in a much better position to secure the benefits you need.”
