Under the Fair Credit Reporting Act, Consumer Reporting Agencies are required to provide a consumer with information about him or her in the agency's files. If there is negative yet accurate information in a consumer's credit history, most negative information, such as late payments and judgments, is automatically deleted after seven years. Under federal law, the 7 years begins 180 days from the date of the original delinquency. The exceptions are bankruptcies, which remain on a credit report for 10 years, and tax liens, which remain for seven years from the time they are paid. If a consumer decides to propose an explanation to the credit reporting agencies, he or she may include a 100-word explanation describing any extraordinary circumstances that led to the bankruptcy, such as the loss of a job or illness.
