Bernstein Liebhard LLP Reports On Developments In DePuy Pinnacle Hip MDL

Bernstein Liebhard LLP reports that the first case management conference in the DePuy Pinnacle hip systems multidistrict litigation will go forward on Tuesday, August 9, 2011. Currently, all federal lawsuits filed by individuals who underwent a total hip replacement and received a DePuy Pinnacle hip prosthesis, have been consolidated and are pending in the U.S. District Court for the Northern District of Texas.

On Tuesday, August 9, 2011, the first case management conference in the DePuy Pinnacle hip multidistrict litigation (“MDL No. 2244”) will take place in the U.S. District Court for the Northern District of Texas before Judge James E. Kinkeade, who is overseeing the consolidated litigation surrounding the metal on metal hip systems. Bernstein Liebhard LLP Partner Jeffrey S. Pinnacle Hip MDL Includes All Configurations Of The Pinnacle Acetabular Cup System

On May 23, 2011, the U.S. Judicial Panel on Multidistrict Litigation ordered that the Pinnacle hip lawsuits pending in federal courts be consolidated and centralized. The panel found that the Pinnacle hip lawsuits share factual questions as to whether the Pinnacle Acetabular Cup System, a device used in total hip replacement surgery, was defectively designed and/or manufactured and whether defendants failed to provide adequate warnings concerning the potential for Pinnacle problems. Currently, at least 57 plaintiffs, who experienced Pinnacle problems as a result of the hip systems, have Pinnacle hip implant lawsuits included in the Pinnacle hip MDL.

Metal on Metal Hip Systems Result In Nationwide Lawsuits

Similar to the DePuy ASR hip systems, which were recalled in August 2010, the Pinnacle Acetabular Cup is also a metal on metal hip device. Thus, individuals who underwent total hip replacement surgery and received a Pinnacle hip implant often experience Pinnacle problems akin to that of patients who received the ASR metal on metal hip systems.
