During Mr. Bussey’s presentation, he considered legal and scientific perspectives concerning the use of inaccurate blood samples to prosecute alleged driving under the influence (DUI) offenders in Colorado. Mr. Bussey was instrumental in exposing the lab’s mistakes and resolving the wrongful DUI convictions of many. Mr. Bussey is a member of the American Chemical Society (ACS).

The Colorado Springs Metro Crime Lab was formed in 1993 as a joint forensic laboratory between the El Paso County Sheriff’s Office and the Colorado Springs Police Department (CSPD). In December of 2009, the CSPD issued a press release stating that errors in blood alcohol content (BAC) results were found as the result of a mid-November internal quality assurance check related to the reporting of a number of BAC readings in some DUI and criminal cases. An internal investigation confirmed that, since January 2009, BAC tests conducted by the forensic chemist unit had been incorrectly reported as higher than the actual result.

Immediately after the release of this information, Mr. Bussey petitioned the CSPD for all Metro Crime Lab records pertaining to the BAC test and reporting procedure under the Colorado Open Records Act (CORA). The majority of the initial request was denied, prompting Mr. Bussey to pursue the request in civil court. Five and a half months later, in May 2010, the requested information was obtained through CORA. Through patience and perseverance, Mr. Bussey facilitated the discovery of the data concerning 206 erroneously reported BAC results, which assisted those accused of DUI offenses.
