An 89 year old man charged with rape and facing the possibility of spending the rest of his life in prison reached an agreement with the State of Ohio. Jolly Smith was charged with 18 counts, including rape and kidnapping, of a 32 year old woman. The case was titled State vs. Jolly Smith, in the Cuyahoga County Court of Common Pleas case number 10-536144.
As a result of aggressive work by his criminal defense attorney Joseph C. Patituce, Mr. Smith walked out of the courtroom a free man only having to pay a $100.00 fine. Mr. Patituce said, "Mr. Smith did not rape anyone, he did not hurt that young girl and I belive this agreement reflects that." Mr. Patituce noted that Mr. Smith served honorably in World War 2 and that the agreement to dismiss all of the felonies in exchange for a misdemeanor reflected the fact that Mr. Smith did not commit rape.
A 24 year old man, Anthony Merson, faced the possibility that he could be charged with a felony burglary in State of Ohio vs. Anthony Merson in Lake County Court of Common Pleas case 10 CR 000467. Mr. Merson was accused of breaking into a liquor store in Port Clinton, Ohio. Mr. Merson was represented by Jaclyn Butler and Joseph Patituce who were able to obtain probation for their client, rather than the possibility of eight years in prison.
