According to an article published by The New Jersey Star Ledger on May 29th, robot surgery is becoming more routine, with the number of hospitals that use the da Vinci robot rising nearly 80% in the past decade. However, the report pointed out that even as use of the da Vinci grows, questions remain about its safety and effectiveness.*

Da Vinci Lawsuits
According to a recent report that aired on the NBC program, Rock Center, Intuitive Surgical’s da Vinci robot was used in more than 400,000 procedures last year. However, since 2007, the FDA has logged more than 200 bad robot surgery reports detailing patients who suffered burns, cuts and infections in da Vinci procedures, including 89 deaths.** In the past, other studies have raised questions about the costs and benefits of robotic surgery. For example, a study published in the Journal of the American Medical Association in February reported that the costs for a da Vinci hysterectomy was more expensive compared to other methods, with little difference in complication rates.***
In January, the FDA sent a survey to hospitals that participate in its product safety network seeking information about complications that might be associated with the da Vinci robot. According to Bloomberg.com, the FDA is trying to determine if the recent increase in adverse event reports involving the da Vinci Surgical System is indicative of a problem with the technology.****
Meanwhile, Intuitive Surgical disclosed on April 19th that it had been named in 26 da Vinci robot lawsuits filed on behalf of alleged victims of bad robot surgery. While the nation’s first da Vinci lawsuit trial ended with a victory for Intuitive last month, the company has also disclosed that it entered into tolling agreements in some claims to suspend the statute of limitations in order to give the parties more time to evaluate the lawsuits and determine if any can be resolved out of court.***** (Estate of Fred E.
