Da Vinci robot lawsuits involving the da Vinci Surgical System continue to mount in courts around the country, Bernstein Liebhard LLP reports. According to Bloomberg.com, at least 10 da Vinci surgery robot lawsuits alleging injuries to internal organs, including the liver, rectum and spleen, as well as one involving a punctured heart valve, have been filed on behalf of individuals who suffered serious complications in surgeries where the da Vinci robot was used. The report also noted that the da Vinci Surgical System has been associated with 70 deaths in informal incident reports sent to the U.S. Food & Drug Administration (FDA) since 2009.*

Da Vinci Surgery Robot Lawsuits
According to Bloomberg.com, the da Vinci robot has been on the market since 2000, while the number of U.S. procedures using the robots has grown to about 367,000 in 2012, compared with 228,000 in 2010. Half of that total included gynecological surgeries, but the da Vinci is increasingly being used in prostate and gall bladder removals, as well as heart surgery. Adverse event reports to the FDA involving da Vinci surgery complications have also increased, jumping to at least 115 in 2012 from 24 in 2009. While this does not prove that the robot caused the complications, Bloomberg.com pointed out that adverse event reports have provided early warnings about medical device problems in the past.
The rise in reports of da Vinci surgery complications has attracted the attention of the FDA. Last week, it was reported that the agency had sent a survey to hospitals participating in an FDA-run product safety network asking them to provide information about adverse events related to the da Vinci Surgical System. Surgeons at those hospitals were asked to list possible da Vinci surgery robot complications they may have seen with the machines, as well as which surgeries the robots might be most and least suited for. They were also asked to discuss their training on the da Vinci Surgical System.**
The news of the FDA survey came just days after the Journal of American Medical Association (JAMA) published a study questioning the overall benefits of robot-assisted hysterectomy. According to the study, about 10% of hysterectomies performed in 2010 involved robot-assistance, compared with just 2.5% in 2007. Complication rates between the robotic procedures and traditional laparoscopies were roughly the same. However, the costs for robotic hysterectomies totaled nearly $9,000, versus about $3,000 for the least expensive method, the study found. ***
