Lawsuit Filed in Dallas Following Fatal Drunk Driving Accident

Grossman Law Offices has filed a dram shop lawsuit filed against KTX Karaoke in response to a fatal drunk driving accident in North Texas.

Part of my job is to advocate for equity. As a matter of public policy, it is not equitable to over-serve patrons for profit, and then turn them loose to the roadways.

Following the drunk driving death of an allegedly intoxicated patron, the dram shop attorneys at Grossman Law Offices filed suit against an alcohol provider where the patron was purportedly imbibing.

On the evening of December 18, 2011, Donghyum Kim left the premises of KTX Karaoke Restaurant in an allegedly intoxicated state. While traveling home on the Sam Rayburn Tollway, Kim purportedly struck a retaining wall, disabling his vehicle. While his vehicle was disabled, it was then allegedly struck by a tractor trailer, fatally injuring Kim.

The suit (Cause No. DC-12-14296) was filed within the K-192nd Judicial District Court of Dallas County alleges the establishment, KTX Karaoke, over-served the decedent to a point where he presented a clear danger to himself, and to others. The decedent was then purportedly allowed to drive home in his intoxicated state. The lawsuit further alleges that following the decedent’s collision with a retaining wall, the driver of the tractor trailer was negligent in failing to perform evasive actions, control the speed of his vehicle, or control the path of his vehicle. The trucker’s company has been named in the lawsuit due to agency law and an alleged failure to properly supervise the driver.

Attorney for the Plaintiffs, Michael Grossman comments, “Of course we do not condone drunk driving, but over-service by a bar facilitates our state’s drunken driving epidemic. Part of my job is to advocate for equity. As a matter of public policy, it is not equitable to over-serve patrons for profit, and then turn them loose to the roadways.”
