Deed and Record’s Nine-Year Anniversary for Real Property in California and Timeshares
HUNTINGTON BEACH, Calif. (PRWEB) June 27, 2019 -- Deed and Record has for nine years prepared and recorded deeds for timeshares located in California, Florida, Hawaii and Nevada and for real property located in California. Deeds are used to carry out the terms of a divorce, to fund trusts, to add or remove co-owners or to change owners without consideration. A deed is a document in a format mandated by State law that change owners of real property.
The deed is signed by the current owner and the signature must be acknowledged by a notary. Each State has designated a sub-state entity to keep track of the deeds. These State entities are the final authority on who owns each and every real property located in the State.
In the Western States, including California and Nevada, this task is assigned to the “county recorder.” The recorder is responsible for all real property located in its county. In Florida, the courthouse of each county is responsible for real property located in that county. Hawaii is the only State that tracks all owners of real property throughout the State by one entity known as the Bureau of Conveyances. Change of owners is effective upon the submission to and acceptance by the State entity of a deed that is copied, indexed and made part of the official record.
Deed and Record prepares deeds to change owners when title insurance is not needed. Examples are; divorces, transfers into and out of trusts, transfers between relatives and transfers due to death. Post death transfers are further broken out into surviving joint tenant, trust and probate court transfers.
As long as the owner or a joint owner is living or a trust owns the real property, ownership change is by deed. But if the real property owner or owners have died without a trust, the assistance of the probate court is required. Another problem is debt secured by the real property and the new owner is not a close relative of the prior owner. Permission to change ownership is needed from the lender to avoid the due on sale clause.
